Terms of service

TERRA, at read.dearwise.earth, is offered by Dear Wise Earth Inc (“we”, “us”). These terms are the agreement between you and us whenever you use TERRA, with an account or without one. By using TERRA you accept them; if you do not, please do not use it.
How we handle personal data is in the privacy notice, and how refunds work is in the refund policy. Both are part of these terms. Write to connect@dearwise.earth with any question.
01What TERRA is
TERRA reads public satellite and open data for a piece of land and interprets it: a score, a verdict and the findings behind them. Reading a parcel is free. TERRA Pro adds private readings, a portfolio, comparison, the analyst, printable reports and private data rooms.
02What a reading is not
A reading is a starting point for diligence and design. It is not a survey, an appraisal, a title search, or legal, financial or engineering advice, and it can be wrong or incomplete where the underlying data is. Check what matters on the ground and with qualified people before you rely on it. Decisions about land remain yours.
03Your account
You must be at least 18 to open an account or pay. If you use TERRA for a company or another organisation, you confirm that you may accept these terms for it.
You sign in with a one-time code sent to your email; whoever controls that inbox controls the account, so keep it secure. One account is for one person.
04Paid plans and our reseller
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.
TERRA Pro is $39 a month or $390 a year, the same for everyone, data rooms included. Prices are in US dollars; tax is added at checkout where it applies. A plan renews automatically at the end of each period, at the price you signed up for, until you cancel.
During the launch, Pro is free for anyone signed in and no card is asked. Before Pro starts charging, every account is told by email at least 14 days ahead, and nothing is charged unless you choose to pay.
A new price never applies to a period you have already paid for. We tell paying members by email at least 30 days before a new price applies to their next renewal, so there is time to cancel.
05Cancelling and refunds
Cancel any time from your account page; the plan stays open to the end of the period paid for. Any payment can be refunded in full within 14 days, as set out in the refund policy.
06Your readings and what you add
A reading made without a paid plan is public: it appears on the public wall, joins the corpus TERRA compares land against, and can be opened by anyone with its link. A reading a paid member keeps private is visible only to them unless they publish it.
Notes, photos and files you add remain yours. You give us permission to store, process and show them only as TERRA needs to do what you ask of it, and to the people you choose. Do not add anything unlawful, or anything you have no right to share.
A data room is yours to run. You decide who receives a passphrase and what each tier sees, and you are responsible for what you put in the room and for how you use what it tells you about its readers.
07The data, the score and the software
The satellite and open data TERRA reads belongs to its providers and is used under their licences, listed on the sources page. The score, the verdict, the way findings are weighed, the writing and the software are ours.
You may use, print, share and quote your own readings, including in work for your clients, as long as the source credits they carry stay with them. You may not copy the service, or gather readings in bulk to rebuild the score or a competing dataset.
08The API
The public API described on the developers page may be used within the limits stated there. These terms apply to it in full.
09Fair use
Do not get around paying for Pro, share an account, resell access, probe or overload the service, upload anything harmful, or collect readings by automated means except through the published API.
10Changes to TERRA
TERRA changes as it is built: sources are added, methods improve, and a score can move when the method is recalibrated. If we remove a main feature of a paid plan, you may cancel and have the unused part of the current period refunded.
11Ending
You can stop using TERRA at any time and delete your account from the account page. We may suspend or close an account that breaks these terms, telling you why where we can. If we close a paid account for any other reason, we refund the unused part of the period.
12Liability
TERRA is provided as it is, without warranties of accuracy or fitness for a particular purpose, to the extent the law allows. To the same extent, our total liability for any claim is limited to what you paid us in the twelve months before it.
Nothing in these terms limits liability that the law does not allow to be limited, such as for fraud, or for death or injury caused by negligence.
13Disputes
If something goes wrong, write to connect@dearwise.earth first. Most things are settled by a reply.
These terms are governed by the laws of the State of Delaware, United States.
If you use TERRA as a consumer, you keep the protection of the mandatory law of the country you live in, and you may bring a claim in its courts.
14Changes to these terms
We may change these terms. The date above shows the latest version; paying members are told by email of any change that affects them before it takes effect.
